We dislike having to begin with a piece of negative news but a couple of days ago we learned that the U.S. Supreme Court won't hear an inmate's claim that Alabama's death sentence law is unconstitutional. It was the first Alabama death penalty appeal to reach the Supreme Court on this issue since Hurst was decided on Jan. 12, and strengthens the position of the Attorney General that our sentencing “scheme” is constitutional. However this will not be the last appeal of its kind!

We are pleased to be able to report that the Florida Hurst ruling is making itself felt in Alabama. One of our Board members who had asked for a rehearing based on the Hurst ruling got word that the U.S. Supreme Court had asked Alabama to respond to  the request. And that is exceptional and also brings hope to others.


In addition, around the state there are conflicting rulings by circuit judges whether the state’s death penalty law is legal, prompting several judges to decline to rule on its constitutionality. Bravo!

What a rollercoaster week this has been for us at Holman! The Alabama Supreme Court set an execution date for Vernon Madison for May 12th and the Attorney General’s office requested execution dates for Robert Melson  and for our Chairman, Ronald B. Smith.

S.B. 237 filed by Senator Brewbaker R. Montgomery and cosponsored by Senators Hightower, Whatley, Stutts, Marsh, Reed, Ward, Smitherman and Figures, made it out of committee by a 10-0 vote. It now moves to the full Senate. Our thanks and appreciation to Stephen Stetson, a lawyer of Alabama Arise for his skilled presentation in favor of the bill and the Innocence panel which he stated was needed “as recognition of human frailty in the justice system”.

We are proud that the law class at Holman offered by our Vice Chairman, Anthony Tyson is reaching out to all the men who are out of appeals. The topic will address the options remaining related to the Florida Hurst ruling as well as to the lethal injection protocol. A positive vehicle for mutual support!


The letters regarding the essay competition were mailed to the various principals. We look forward to their response.
